Three Years of Israeli Violations of International Humanitarian Law in the Occupied Palestinian Territories: The Need for Accountability

Today, on the third anniversary of the outbreak of the Al-Aqsa Intifada, PCHR submitted a memorandum to the High Contracting Parties to the Geneva Convention Relative to the Protection of Civilian Persons in Time of War of August 12, 1949, summarizing violations of the Convention over the last three years and calling for immediate action to protect Palestinian civilians. The memorandum presents updated information on Israel’s systematic violations of international humanitarian law, specifically the Fourth Geneva Convention, against Palestinian civilians in the Occupied Palestinian Territories (OPTs) since 29 September 2000.The memorandum highlights in particular grave breaches of the Convention, providing statistics and information on willful killings, assassinations, torture and inhuman treatment, closures and curfews, unlawful deportations and transfers, wilfully causing great suffering and serious injury, and extensive destruction and expropriation of civilian property. Adalah demands investigation Israel''s border police shooting of a Palestinian in Kufr Qassem

On 17 September 2003, Adalah sent a letter to the director of the Ministry of Justice Police Investigation Unit ("Mahash"), Attorney Herzel Shviro, demanding that Mahash conduct an investigation and recommend that the Border Police officer responsible for shooting a Palestinian citizen of Israel in Kufr Qassem be criminally indicted. The letter was prepared by Adalah Attorney Marwan Dalal. In the early afternoon on 11 September 2003, Mr. Salah Amer, was shot in the waist from close range by a Border Police officer. At the time of the shooting, Mr. Amer was attempting to convince a Border Police patrol unit to release his son and nephew from custody and to call an ambulance for them to receive medical attention. Mr. Amer saw his son, who had been badly beaten, sitting in the police car, visibly injured and handcuffed. The Border Police refused, upon which Mr. Amer was shot.

Abdelrazeq: Thousands of Palestinian Prisoners Humiliated by Israel

GAZA, Palestine, September 18, 2003 (IPC)-- Palestinian Minister of Prisoners Affairs, Hesham Abdelrazeq, said that Palestinian prisoners held in Israeli prisons are being exposed to harsh Israeli practices including physical torture, solitary confinement, beating and tear gas inhalation. In a press conference held Wednesday by the International Press Center (IPC) in Gaza, Abdelrazeq went onto saying that along with the said practices, Israeli prison administrations have recently installed glass walls in prison rooms, preventing warm family visits, followed recently by Israeli complete denial of visits made regularly by prisoners’ families to their beloved ones.

Palestinian victims submit legal complaints against Israeli authorities in Switzerland

Yesterday, Swiss attorney, Marcel Bosonnet, and Director of the Palestinian Centre for Human Rights, Raji Sourani, submitted two complaints to the Swiss Military Attorney General in Berne on behalf of Palestinian victims.One complaint is in respect of Palestinians whose homes were demolished by Israeli occupying forces; the second complaint is in respect of Palestinians who were subjected to torture and ill treatment in detention by the Israeli security services.The complaints call for investigation and prosecution of those responsible for these acts.

Israeli Senior Officials Face War Crime Charges in Swiss Courts

Geneva, September 6, 2003 (IPC + Agencies)-- A Swedish lawyer has brought to the Swiss courts a war crime indictment against the Israeli Defense Minister, Shaul Mofaz and his predecessor, Benjamin Ben-Eliezer, for crimes they perpetrated against unarmed civilians in Palestinian cities, towns, villages and refugee camps. Marcel Bosonnet, the Swedish lawyer, told the press that he filed complaints concerning the destruction of Palestinian homes in the southern Gaza Strip in early 2002 as well as the torture of Palestinians at the hands of Israeli soldiers.

The Public Committee Against Torture in Israel on Thursday called on Prime Minister Ariel Sharon, Defense Minister Shaul Mofaz and Attorney General Elyakim Rubenstein to revoke the classification of Facility 1391 as a close military prison, and to refrain from imprisoning there suspects, defendants and convicted detainees. The organization''s lawyers, Avigdor Feldman and Michael Sfarad, emphasized that if authorities are interested in operating the facility as a regular military prison, they must hand its management over to the military police. The facility must also be open to visits by lawyers, representatives of the Red Cross and human rights organizations, the groups said.
