Mr. Falk noted that “a wide range of violations of international human rights and international humanitarian law could be linked to actions carried out by the Government of Israel under these Orders, with particular gravity in the event that young persons become victims of their application.” “The Orders appear to enable Israel to detain, prosecute, imprison and/or deport any and all persons present in the West Bank,” noted the Special Rapporteur, basing his concern on Israel’s new definition of the term ‘infiltrator:’ “A person who entered the Area unlawfully following the effective date, or a person who is present in the Area and does not lawfully hold a permit.” “Even if this open-ended definition is not used to imprison or deport vast numbers of people, it causes unacceptable distress,” the UN independent expert said. Mr. Falk further noted that “it is not at all clear what permit, if any, will satisfy this Order.” “Illustrative of the potential for cruel abuse,” he said, “is a provision of the Order requiring the person deported to pay the costs of his or her deportation, and suffer confiscations of property if unable to pay.” Mr. Falk warned that deportations under the two new Orders could take place without judicial review, and that detained persons can be imprisoned for 7 years, unless able to prove that their entry was lawful, in which case they would be imprisoned for 3 years. more.. e-mail Huwwara detainees allege medical negligence 4/20/2010 - Nablus - Ma'an - Prisoners in the Huwwara detention center south of Nablus have accused the Israeli Prison Service of deliberate medical negligence, the Palestinian Prisoners Society said Tuesday. A Nation Behind Bars: Palestinian Political Prisoners In Israeli Detention Reham Alhelsi, My Palestine 4/17/2010 While the whole world demands the release of the Zionist soldier Shalit, who was captured by Palestinians while he was on a mission to kill and destroy, the so-called "free world" continues to ignore that the Zionist entity holds a whole nation hostage. The Palestinian people in occupied Palestine have been held hostage by a brutal military occupation, confined to ghettos build on their own lands. Some 2.5 Million Palestinians in the West Bank and East Jerusalem are captives in their own homes, towns and villages, with military checkpoints locking them up, controlling and limiting their movement. 1.5 Million Palestinians are held hostages in the open-air prison Gaza, not allowed to leave even for urgently needed medical treatment. In addition to that, there are over 8500 Palestinians locked up behind bars in Israeli dungeons. These 8500 Palestinians unite occupied Palestine from the River to the Sea; they unite Jerusalem with Yafa, Jenin with Ara, Hebron with Nazareth, Gaza with Akka. These 8500 Palestinians unite families, unite the pain, unite the hope and unite the struggle for freedom. Almost every Palestinian family has had at least one family member detained by Israel. Almost every Palestinian family has been abused by Israeli soldiers while visiting their loved ones. Almost every Palestinian family has known the pain of waiting, the fear of what might happen behind bars, the hope for a near release and a safe return home. Every Palestinian family knows the meaning of detention, has felt it directly through its members. Every Palestinian family knows the meaning of freedom, for we pay the highest price for the sake of this freedom, and we love our freedom, we cherish our freedom and we yearn for our freedom and would always fight for it. Since 1967, Israel detained some 750,000 Palestinians, including 12,000 women and tens of thousands of children. During the First Intifada 116,000 Palestinians were detained. Since the beginning of Al-Aqsa Intifada in 2000, 70,000 Palestinians were detained, including 900 women and 8000 children. On average, 9000 Palestinians are detained yearly, including 700 children. Richard Falk: 'I believe that Hamas should be treated as a political actor' Middle East Monitor (MEMO) 4/9/2010 Richard Falk is the UN Special Rapporteur on the situation of human rights in the Palestinian territories occupied since 1967. In 2001 Falk served on a United Nations High Commissioner for Human Rights (OHCHR) Inquiry Commission for the Palestinian territories with John Duggard. He is also an American Professor Emeritus of International Law at Princeton University with a long and distinguished career in academics, politics and law. He recently gave this exclusive and revealing interview to the Middle East Monitor’s Dr Hanan Chehata. HC: Following your appointment as UN Rapporteur to the Occupied Palestinian Territories in 2008 you traveled to Israel in order to begin your investigations. Can you tell us a little more about how you were received by Israel? RF: I was denied entry and expelled at Ben Gurion Airport when I tried to enter Israel for the purpose of carrying out my duties as UN Special Rapporteur. These duties consist mainly of reporting on Israeli compliance with human rights obligations in the Occupied Palestinian Territories, and include duties of compliance with respect to international humanitarian law. Israeli authorities confined me for more than 15 hours in a detention cell with five other detainees before putting me on a plane. I was given no explanation beyond that my expulsion order came from the Israeli Foreign Ministry that had objected to my appointment from the outset. As my itinerary on the West Bank had been previously submitted to the Israeli embassy in Geneva, and as visas had been granted to the two UN employees assisting me on the mission, it seems clear that Israel wanted to have the incident at the airport rather than tell me in advance that I would be denied entry. The UN High Commissioner for Human Rights and other UN officials did object to the Israeli refusal to allow me to do my job as Special Rapporteur. It should be pointed out that the UN Charter in Article 2(2) requires Members to cooperate with the UN in carrying out its functions, and that this duty is reinforced by an international treaty outlining this duty of cooperation. HC: You were denied entry into the OPT. Have you been allowed at any point to enter the territory? If not, how have you been able to do your job?.... more.. e-mail Israel’s ’crisis of legitimacy’ Jared Malsin, Maan News Agency 4/13/2010 I know something about how Israel’s security forces treat journalists they view as hostile. In January, I was held for over a week in a dingy detention center at Israel’s Ben Gurion International Airport before being deported. Before I was detained, I was interrogated in a spare, windowless office in the airport about news articles I had authored in my two and a half years working in the occupied West Bank for the Palestinian news agency Ma’an. At one point, the security officer, a woman with piercing blue eyes who never identified herself, paged through the contacts in my cell phones, demanding that I provide information about sources, colleagues, and friends whose numbers I had stored. I refused. She set the phones down on her desk and I, without thinking, reached for them. She stopped me. "In this office, you have no rights," the interrogator explained. I didn’t see the phones, like the rest of my possessions, until I was expelled to New York eight days later. So it’s natural that I’ve been following and investigating for weeks the case of Anat Kamm, the Israeli journalist and former soldier who has been under secret house arrest for months over allegations she leaked military documents, and Uri Blau, the reporter who reportedly used those papers to expose a West Bank assassinations program that violates even Israel’s own laws. Like me, Blau, a reporter for the Israeli newspaper Haaretz, also finds himself unable to return to Israel. I’m not Israeli, and Blau’s situation is different and, in important ways, much more severe than mine. But I believe I can empathize, on some basic level, with the Kafkaesque turn his life has taken. more.. e-mail affecting and affected In Gaza: 11 Apr 2010 - Abu Basel (right) is one of the long-termers, having served over 20 years as a medic in Gaza. “Who will take care of people if not us? Also likely to be targeted are foreign-born spouses of Palestinians. Until now, Israeli civil courts have occasionally prevented the expulsion of these three groups from the West Bank. The new order, however, puts them under the sole jurisdiction of Israeli military courts. The new order defines anyone who enters the West Bank illegally as an infiltrator, as well as “a person who is present in the area and does not lawfully hold a permit.” The order takes the original 1969 definition of infiltrator to the extreme, as the term originally applied only to those illegally staying in Israel after having passed through countries then classified as enemy states – Jordan, Egypt, Lebanon and Syria. The order’s language is both general and ambiguous, stipulating that the term infiltrator will also be applied to Palestinian residents of Jerusalem, citizens of countries with which Israel has friendly ties (such as the United States) and Israeli citizens, whether Arab or Jewish. All this depends on the judgment of Israel Defense Forces commanders in the field. Spinning Cast Lead Jane Adas, The Link, November - December 2009, Americans for Middle East Understanding - AMEU 11/1/2009 “Those who can make you believe absurdities can make you commit injustices.” Voltaire was writing in 1765 about people who commit atrocities in the name of religion. But governments, acting through politicians and pundits, can rally people to commit injustices, or at least to cheer on those who are sent to do violence in the name of the people. Remember yellowcake from Niger, mobile biological weapons factories, and clandestine meetings in Prague? These were some of the subterfuges intended to link Saddam Hussein to the atrocities of 9/11. Remember Operation Iraqi Freedom? “We have nothing against the people of Iraq”? “The United States does not torture”? Such slogans were designed to keep our consciences and our common sense drowsy. These kinds of propagandist stratagems have been used from the beginning of the Palestine/Israel situation. Some of the mantras don’t work as well as they used to. Who today believes Palestine was a land without people or that Israel is a tiny David facing an Arab Goliath? But many are still in vogue, for instance “The IDF (Israel Defense Forces) is the most moral army in the world” and “Israel has repeatedly stretched out its hand to peace, but has never found a partner on the other side.” These days Israel is deploying an array of tactics to neutralize the many critical reports that have come out in the wake of Israel’s Operation Cast Lead assault on Gaza last winter, especially the Goldstone Report commissioned by the U.N. Human Rights Council. Israel’s reactions, obediently echoed by even the Obama administration, offer a case study in techniques of damage control, in Hebrew “hasbara:” deny, justify, de-contextualize, obfuscate, smear, deflect, make us all forget about it, make us believe absurdities. -- See also: PDF version more.. e-mail Prisoners still detained after completing sentences 4/3/2010 - Gaza - Ma'an - Israel has refused to release two Palestinian prisoners even though they completed their sentences, the Popular Movement for the Support of Prisoners and Palestinian Rights reported Friday. And at the same time seeing all our hope in Christ who offers eternal life, we remember the most important words of all, “Forgive them, for they do not know what they are doing” (Luke 23:34) Thus on this most holy day, we must forgive that we live behind the huge Apartheid Wall that keeps us as prisoners in an open space.
